In this action for breach of an insurance contract, plaintiff appeals and defendant cross-appeals plaintiff's judgment for $400, "together with * * * reasonable attorney fees and costs and disbursements in an amount to be assessed pursuant to ORCP 68." In effect, the judgment denied plaintiff coverage under the major medical provisions of defendant's policy for expenses that he incurred, more than 90 days after an accident, for treatment of injuries...
