FACTS

Paul Zizak claimed he was not promoted, as a result of age discrimination. The executive director of respondent commission found no probable cause to sustain the charge. Zizak appealed to a three-member review panel, which sustained the director's determination. Zizak sought certiorari review in the Court of Appeals.
