OPINION

NIERENGARTEN, Judge.

Appellant A.J. DeAntoni seeks review of a July 22, 1987, order and an August 17, 1987, summary judgment dismissing his declaratory judgment action against respondents1 as moot and for failing to present a justiciable controversy. We affirm.
