SINGLETON, Judge.

Sidney R. Hertz was indicted for murder in the first degree. AS 11.41.100. Hertz was convicted, following a jury trial, of the lesser-included offense of murder in the second degree. AS 11.41.110. Superior Court Judge J. Justin Ripley sentenced Hertz to forty years' imprisonment with no eligibility for parole until he had served twenty years. Hertz appealed, challenging his conviction and...
