The defendant, Russell Will, was charged with third offense driving while intoxicated (DWI), in violation of La.R.S. 14:98. He filed a motion to quash, asserting the predicate offenses could not be used to enhance the charge because he was not properly Boykinized when he pled guilty to them. The trial court quashed one of the predicate offenses on this basis. The state deleted the quashed predicate offense and amended the charge to second offense...
