Luther Lay, Randolph Lay, and Henry Shiver filed suit on January 5, 1987, in Baldwin County Circuit Court against Annette McInnis and Marie Madison. In the first count of their complaint, they asked the court to establish a permanent easement across McInnis's property and to enjoin her from obstructing that easement.
