This matter is presently before the court on the motion of United Food and Commercial Workers International Union, AFL-CIO/CLC and Local Union 340, United Food and Commercial Workers (Unions) to dismiss Count I of plaintiffs' second amended complaint for failure to state a claim upon which relief can be granted. Count I of plaintiffs' second amended complaint alleges that the Unions breached their duty of fair representation...
