The petition for review is allowed. The decision of the Court of Appeals is reversed. The case is remanded to the Court of Appeals for further consideration in light of this court's opinions in State v. Atkinson, 305 Or. 295, 751 P.2d 784 (1988) and Dooney v. Department of Transportation, 305 Or. 307, 751 P.2d 790
