This appeal arises from a judgment of divorce based upon adultery which was granted in favor of the husband, Dr. Jerry Dwayne Helms, against the wife, Edna Dale Smith Helms. Mrs. Helms has appealed that judgment. Dr. Helms has answered the appeal seeking damages for a frivolous appeal. A motion to dismiss the answer to the appeal was filed by Mrs. Helms.
