Janice Bacon sued the State of Texas for personal injuries to herself, and as representative of the Estates of Donald Ray Bacon and Elizabeth L. Mayer, she brought a wrongful death action against the State of Texas. These actions were based upon allegations of negligence against the Texas Department of Highways and Public Transportation for failing to warn motorists of known hazardous road conditions.
