The Federal Deposit Insurance Corporation ("FDIC"), as the receiver of Tri-State Bank ("Tri-State"), is appealing the decision of the United States Bankruptcy Court denying FDIC's motion for modification of an automatic stay. For the following reasons, the decision of the court below is reversed and the case remanded.
