The defendant, Steven A. Martin, was convicted by a jury in the Circuit Court of Kanawha County of burglary in the daytime by breaking and entering and aggravated robbery. He was sentenced to an indeterminate term of from one to fifteen years in the penitentiary on the burglary charge and to forty-five years in the penitentiary on the robbery conviction, the sentences to run concurrently.
