The appellees sued the City of Dallas seeking to be reimbursed for the construction of a sewer line. the complaint was predicated both on breach of contract and quantum meruit. The trial court granted summary judgment to the appellees with respect to the city's liability on the quantum meruit claim, reserving the issue of damages for trial. The city appeals.
