COMPTON, Justice.

This appeal and cross-appeal are from the granting of Wayne L. Mitchell's (Mitchell) motion for summary judgment and Marlin D. Smith's (Smith) motion for partial summary judgment respectively. At issue is whether Mitchell had a valid lien for wages and wage penalties due him and whether Smith, Mitchell's attorney, negligently failed to foreclose Mitchell's liens.
