Ordered that the order is modified, on the law, by deleting the provision thereof which granted summary judgment to the defendant Pellin, and substituting therefor provisions denying him summary judgment and granting the plaintiffs leave to renew their motion to dismiss the defendant Pellin's affirmative defense upon the completion of discovery. As so modified, the order is affirmed, with costs to the plaintiffs.
