Plaintiff Edward Kay ("Kay"), Secretary-Treasurer of Local 1199, Drug, Hospital and Health Care Employees Union ("Local 1199" or "Local"), an affiliate of the International Retail, Wholesale and Department Store Workers Union ("RWDSU"), has moved pursuant to Fed.R.Civ.P. 65 for a preliminary injunction staying the RWDSU's temporary suspension of Kay from his Local 1199 duties as an officer.
