CALOGERO, J., concurs, being of the view that the judgment of the district court declaring the statute unconstitutional has no force and effect, except as between the parties, because the appeal in this case has been dismissed simply because moot.

DENNIS, J., concurs believing that it is the intent and effect of the majority's judgment that the trial court's judgment has been rendered moot and of no legal effect by appellee's resignation...
