OPINION

BURDOCK, Justice.

Appellant, Mark Amos Webb, appeals from the trial court's denial of his application for a writ of habeas corpus. We affirm the decision of the court below.

Appellant was convicted of rape. See TEX.PENAL CODE ANN. sec. 21.02 (Vernon 1974). This court subsequently reversed appellant's conviction on appeal and remanded the cause for a new trial. See Webb v. State, 684 S.W.2d 800
