On March 26, 1985, defendant was indicted by an Albany County Grand Jury and charged in four separate counts with sodomy in the first degree, attempted sodomy in the first degree, attempted rape in the first degree and sexual abuse in the first degree. The indictment arose out of the complaint of a woman who reported to an investigator with the Albany City Police Department that, on January 15, 1985, someone had assaulted and tried to rape...
