Appellants McCullohs Service Station, Inc. and Charles A. McCullohs brought this action against appellee Talmadge J. Wilkes alleging negligence in failing to obtain a certain amount of automobile liability insurance coverage. Following discovery appellee moved for summary judgment which was granted "as it relates to a negligence claim" and denied "as [it] relates to a fraud claim."
