In the only assignment of error directed to the guilt-innocence phase of his trial, defendant contends that the same evidence was used by the State to obtain his conviction of each of the three charges of second degree rape. He argues that the three instances in which he penetrated Ms. Still's vagina with his penis constituted but a single continuous incident and "merge" into one criminal act, so that he can be convicted of only one rape.
