Defendant Baines was indicted on two counts; Count I for conspiracy to possess with the intent to distribute more than 1,000 pounds of marijuana, and Count II, for possession with intent to distribute the same. 21 U.S.C. §§ 841(a), 841(b)(1)(B) and 846. He was found guilty on Count I, and acquitted on Count II. He appeals, alleging error in the denial of his motions for acquittal and for a new trial for insufficiency...
