This wrongful death action was brought by the administrator and family of Brenda Payne, who died after being struck by an automobile driven by appellant Nelda Williams. The accident occurred at night during a misty rain. Mrs. Payne was walking on the right side of Highway 36 with her back to east bound traffic.
