This cause came on to be heard upon an appeal from the Court of Common Pleas of Hamilton County.

Plaintiff-appellant Edward Lee ("Lee") and his passenger were injured when the motor scooter ("moped") upon which they were travelling was struck by a Queen City Metro bus on August 17, 1983.
