Vahey appeals his conviction for first degree burglary contending the trial court erred in: (1) refusing to submit to the jury two of his proposed instructions on identity; and (2) denying his motion to dismiss, or alternatively granting a new trial, based on the alleged inconsistency between the jury's verdicts.
