The plaintiff, Utility Workers Union of America, AFL-CIO, ("UWUA"), seeks a declaratory judgment that section 606 of the Omnibus Diplomatic Security and Anti-Terrorism Act of 1986 is unconstitutional on its face and as applied to those members of the UWUA working at nuclear power facilities to the extent that it requires submission to fingerprint checks.
