The Colorado Department of Revenue, Motor Vehicle Division [hereinafter DMV], appeals from the court of appeals' holding in the unpublished opinion Olona v. Charnes, No. 84CA1430 (Colo.App. Jan. 23, 1986) [hereinafter Olona]. In Olona, the district court had reversed DMV's revocation of Olona's driver's license, and the court of appeals affirmed, based on its due process holding in Kirke v. Motor Vehicle Division,
