Respondent moves for a dismissal of the captioned delinquency petition, pursuant to Family Court Act § 315.1 (1) (a), upon the ground that it does not comply with the legal sufficiency criteria established by Family Court Act §§ 311.1 and 311.2. More particularly, he claims that it fails to establish by nonhearsay evidence an essential element of the underlying crime.
