OPINION AND ORDER

ACOSTA, District Judge.

Roberto Díaz filed a petition for injunctive relief and declaratory judgment against the United States Postal Service, Cristobal Lliteras and Carlos J. Falú requesting, inter alia, reinstatement and backpay1.

Jurisdiction against the defendants is predicated under 28 U.S.C. § 1331 and 28 U.S.C. §§ 2201 and 2202.
