Christopher Martin Custard was convicted by a jury of aggravated assault. Based upon the recommendation of the jury, the trial court assessed punishment at ten years confinement in the Texas Department of Corrections, probated for ten years, and a $5,000 fine. As a condition of probation, the trial court sentenced Custard to thirty days confinement in the Dallas County Jail.
