The order of the Appellate Term should be reversed, defendant's motion to vacate the judgment of conviction denied and the judgment of conviction reinstated.

Defendant, a physician, entered into a fee-splitting arrangement with her landlord in which she agreed to pay the landlord a percentage of her earnings. As a result, she was charged with and pleaded guilty to violating the Public
