The defendant, Janice Hatcher Sloan, was convicted of shoplifting by a jury in the Circuit Court of Cabell County. Pursuant to W.Va.Code, 61-3A-3 [1981] which makes third offense shoplifting a felony regardless of the value of the items shoplifted, the defendant was sentenced to one to ten years in the penitentiary.
