Defendant, Lamaruin Poteat, is charged with the crime of criminal possession of a weapon in the third degree. Defendant moves, pursuant to Mapp v Ohio (367 U.S. 642 [1961]) for suppression of a weapon seized from his person, on the grounds that such evidence was obtained in violation of his constitutional rights.
