Respondent Kirk Dahlheimer was charged with three gross misdemeanors: driving while under the influence of alcohol within five years of a prior conviction; driving while under the influence within ten years of two prior convictions; and driving after revocation, in violation of Minn.Stat. § 169.121, subd. 1(a) and subd. 3(a) and (b) (1986) and Minn.Stat. § 169.129 (1986).
