This appeal arises from a negligence action brought on behalf of plaintiff/appellant, Dudley A. Stadler, III (Stadler) against the defendants/appellees, Everard J. Agard (Agard), Agard's employer, Brown & Root, Inc. and their insurer, Highlands Insurance Company.
