The plaintiff/appellant in this suit is Sherman A. Bernard, Commissioner of Insurance, State of Louisiana, as rehabilitator of First Republic Life Insurance Company (hereinafter Plaintiff). Defendant/appellee is J. Burton LeBlanc (hereinafter Defendant). Plaintiff appeals the judgment of the trial court, following trial on the merits, in favor of Defendant.
