This case arises from a suit to enforce an agreement to purchase and sell immovable property, or in the alternative for damages. Partial summary judgment was rendered, declaring the contract to be null and void, which judgment was not appealed. The appeal before this court is brought by the plaintiff-prospective purchaser and the intervenor-real estate broker from judgment on the merits, awarding damages to the plaintiff.
