The plaintiff, Richard G. Dattoli, brought this action against Hale Hospital and Christine Bourgeois, a nurse at the hospital, alleging medical malpractice. The defendants filed a motion for summary judgment on the ground that the plaintiff had not first presented his claim to the hospital, a public employer, as required by G.L.c. 258, § 4.
