Upon bench trial in District Court, the defendant Patrick Higgins was convicted of three "bad check" charges, namely: (1) larceny of property over $100, G.L.c. 266, § 30; (2) larceny by check, G.L.c. 266, § 37; (3) larceny of property $100 dollars or less, G.L.c. 266, § 30. He had initially signed a waiver of right to counsel on the first charge, but counsel was later appointed to represent him on this and the second charge...
