QUIRICO, J.
On January 23, 1985, the defendant, Jeffrey Pond, was indicted for the crime of "indecent assault and battery on a female child under the age of fourteen," allegedly committed on November 30, 1984, in violation of G.L.c. 265, § 13B. Having waived his right to trial by jury, the defendant was tried before a judge of the Superior Court, found guilty of the offense charged, sentenced, and now appeals therefrom.
