On October 14, 1984, Andres Martinez was shot seven times. Defendant was arrested on November 1, 1984 at the apartment of a girlfriend, Blanca Helfgott. Found in the apartment was a .38 caliber automatic pistol which, a ballistics expert testified, was the gun used in the killing of Martinez.
