Appellant sued respondent, seeking reimbursement of attorney's fees incurred in successfully defending criminal charges arising out of appellant's employment. Respondents brought a motion to dismiss under Rule 12 of the Minnesota Rules of Civil Procedure, on the basis that the complaint failed to state a claim on which relief could be granted and submitted matters outside the pleadings for the court's consideration.
