Stoney Byrd Jordan was indicted for breaking and entering a vehicle, to-wit, a 1978 Pontiac, with the intent to commit a felony or theft therein, to-wit, theft of property contrary to § 13A-8-11 Code of Alabama 1975, as amended. The jury found the appellant "guilty of breaking and entering a vehicle as charged in the indictment." At the sentencing hearing the appellant was sentenced as a habitual felony offender...
