This matter came to be heard upon the motion of defendant Sue Owens for an order dismissing the charge against her on the grounds that the Wadsworth city ordinance that the defendant is accused of violating is unconstitutional.

Pursuant to agreement of counsel, this motion is being decided on the basis of written briefs submitted by the parties.
