In this appeal we are called upon to determine the propriety of the summary judgment entered in the Court of Common Pleas of Hamilton County in favor of the defendants-appellees, Smith & Schnacke and Judson Hoy, hereinafter appellees.1 For the reasons that follow, we affirm the judgment of the court below.
