Defendant was indicted for criminal possession of a weapon in the third degree (Penal Law § 265.02) and criminal possession of a controlled substance in the seventh degree (Penal Law § 220.03). In November 1985 defendant filed an omnibus motion seeking suppression of six glassine envelopes of heroin and a loaded .38 caliber revolver recovered from his car at the time of his arrest.
