MEMORANDUM OPINION AND ORDER

KANE, District Judge.

On March 17, 1987 the late Judge McGrath of the United States Bankruptcy Court for the District of Colorado issued an order permitting debtor to reject its collective bargaining agreement with appellant trust funds.
