OPINION

BRUCE FOX, Bankruptcy Judge:

Presently pending before me in this chapter 11 case are (1) the motion of debtor Diaconx Corp. ("Diaconx") for permission to expend estate funds for purchase of a trial transcript in connection with an adversary proceeding which was tried in the district court and (2) the complaint and motion for preliminary injunction of Hamilton Bank ("Hamilton") to enjoin Diaconx's use of cash collateral.1
