It arises from an order entered on August 7, 1985, by the Circuit Court of Ritchie County, in which the appellant was sentenced to an indeterminate period of not less than one nor more than five years in the state penitentiary and fined $5000 for the manufacture of marihuana in violation of W.Va.Code, 60A-4-401(a)(ii) [1983].
