This is a death penalty case. Appellant, Tracy Lee Housel, was indicted in Gwinnett County on charges of murder, rape, motor vehicle theft and three counts of financial-transaction-card theft. After a jury was selected, Housel pled guilty to murder and motor vehicle theft. The state did not pursue the remaining charges, but continued to seek the death penalty on the murder count.
